!!! UNKNOWN CONTENT TYPE !!!

I am speaking this afternoon for a group of auto repair shops. I have been doing some smaller chapter meetings around the state, but this is their big annual conference. I have yet to get much work from this effort, but we will see.

Any of you California Oppos involved in the auto repair business, what labor issues do you face? Compensation? Safety? Tools? Harassment? Let me know, and maybe we can get some of these guys to fix it.

I have a hearing at the commissioner’s office in a few hours. I’m suing a past employer for unpaid overtime, unpaid breaks, and unpaid business expenses.

If you want more detail of the crap I’ve dealt with on a regular basis I can email you about it so you have a better idea of what to tell shop owners in the future.

So the Commissioner is telling me that even though IWC Order 9 says an employer is required to pay double the minimum wage when they require the employee to furnish tools, and doesn’t, all they’re liable for is the cost of tools outside of “normal hand tools” like sockets, ratchets, and wrenches. There are no other penalties. The labor attorney I had in my last case said the employer was liable for the reasonable rental cost of my tools.

I find it ridiculous that an employer can intentionally ignore a wage order, require the employee to spend tens of thousands of dollars, and then there are no penalties.

I’m very interested to hear how it went. I manage (but, critically, don’t own) a small Euro shop in SLO and try to keep abreast of the latest in industry news and issues, while the owner is... less than proactive about such things. I appreciate your posts on Ag issues so I’d love to get your perspective on our little ass-backwards world.
